Stickley Audi & Co. Grand Opening $10,000 Shopping Spree

1. NAME OF PROMOTION:   Stickley Audi & Co. Grand Opening Shopping Spree (the ‘Sweepstakes’)
2. SPONSOR AND ADMINISTRATOR:  This Sweepstakes is sponsored and administered Stickley Audi & Co (“the Sponsor and Administrator”).
3. ELIGIBILITY: To be eligible, entrant must be a legal U.S. resident of NJ, NY, MA, CT, CO, or NC, at least 21 years of age or older.  Employees of the Sponsor and their immediate family members are not eligible. By participating in this Sweepstakes, all entrants agree to be bound by these Official Rules and agree that decisions of the Sponsor will be valid and binding in all respects. The Sponsor is not responsible for incomplete, inaccurate or invalid entries. Copies of all entry forms submitted for verification will become the property of the Sponsor and, by completing the Sweepstakes Registration, all entrants consent to the limited use of information provided on the form by the Sponsor, but will have the ability to opt out of any subsequent e-mail correspondence.
4. HOW TO ENTER:
   1. Online: No Purchase Necessary.  Online registration begins March 8, 2019 at 12:00:01am ET and ends May 31, 2019 at 11:59:59pm ET.  To enter the Sweepstakes, consumers may register online at www.campaign.stickleyaudi.com. Upon completing the Sweepstakes Registration, entrants will receive one (1) entry in the grand prize drawing (the ‘Grand Prize’).  Maximum of one (1) Sweepstakes Registration per person regardless of entry method in Sweepstakes.  Any effort by an entrant to misrepresent himself or herself through the use of aliases or multiple e-mail addresses or telephone numbers or misrepresent his or her eligibility age or identity will disqualify that entrant.
   2. Register to Win In Store: Official entry forms will be made available (while supplies last) at participating Stickley Audi store locations (see below) during normal business hours beginning on 3/8/2019 and ending on 5/31/2019.  Fully complete an official entry form with all required information and deposit into the official registration box provided at Sponsor location. No photocopied or mechanically reproduced entries permitted.  All eligible entries must be received by close of business on 5/31/2019.  Limit one entry per person.  Incomplete or illegible entries will be disqualified.

5. WINNER SELECTION AND NOTIFICATION:

Grand Prize Drawing: A random drawing of Grand Prize entries will be made on or about June 5, 2019. One (1) potential Grand Prize winner will be drawn at random from among all eligible entries received. The potential Grand Prize winner will be notified via e-mail within 72 hours of the drawing. The potential Grand Prize winner will have seven (7) days to claim their Grand Prize by responding to the email notification by the Sponsor. An unclaimed Grand Prize will be forfeited, and the entrant selected as the potential Grand Prize winner will have no further claim to the Grand Prize. Sponsor will not award a forfeited Grand Prize to another participant. The Grand Prize cannot be transferred, substituted, or redeemed for cash. Upon acceptance of a Grand Prize, the Grand Prize winner shall be deemed to have waived all claims against the Sponsor arising out of entry in the Sweepstakes. Tax liabilities and delivery charges on all furniture are solely the responsibility of the winner. Sponsor reserves the right to substitutes a prize of equal or great value.

Bonus Prize Drawing: A random drawing of Bonus Prize entries will be made on or about June 5, 2019, following the Grand Prize winner selection. One (1) potential Bonus Prize winner will be drawn at random. Grand Prize winner is not eligible to win the Bonus Prize. The potential Bonus Prize Winner will be notified by email within seventy-two (72) hours after the date of random drawing. The terms and conditions stated in “Winner Selection and Notification” above shall also apply to the Bonus Prize winner, and winning is contingent upon fulfilling all requirements in these Official Rules.

6. PRIZES:

Grand Prize (maximum of (1) one): The Grand Prize is: a $10,000 store credit for the purchase of any furniture at a participating Stickley Audi store at the prevailing retail selling price in the store at the time the furniture is selected. Special order items will be included. The Grand Prize winner will be responsible for all sales tax and delivery charges for the furniture. The Grand Prize winner will have until July 31, 2019 to use the store credit, after which the balance remaining on the store credit will expire. Grand Prize winner will be required to complete and return a W-9 form or appropriate tax form (if prize value exceeds $600.00), affidavit of eligibility, and liability/publicity release (Tennessee residents need not sign publicity release), and present a valid driver’s license and social security card before prize will be awarded. Winners of prizes greater than $600.00 will be issued a 1099 form reflecting the value of the prize and are responsible for paying all income taxes on prize.

Failure to collect or properly claim any prize in accordance with these rules will result in forfeiture of the prize. If forfeited for any reason, finalist will not receive any other prize substitution or compensation.

Bonus Prize (maximum of (1) one): The Sponsor reserves the right to award the Bonus Prize winner one of the following prizes, at the Sponsor’s sole discretion:

• $500 USD Gift Card. Gift Card will be an American Express or other Merchant selected by Sponsor. Additional terms and conditions appearing on the Gift Card may be imposed by Merchant.
• $500 store credit for Stickley Audi.

If Bonus Prize is issued as store credit, the credit may be used for any available product, project or services that is available or provided by a participating Stickley Audi store. Any portion of the total credit value may be redeemed at any participating Stickley Audi store, as requested by winning contestant, provided the maximum value of total combined credits does not exceed $500. Maximum retail value of grand prize award not to exceed $500. Store credit has no cash value, and may not be exchanged or redeemed for any other prize. All credits must be used July 31, 2019 or any full or partial remaining credit value will be forfeit. Credits may be used in partial increments. Any unused portion of credit will not be refunded as Cash, and unused balances will expire as of August 1, 2019. If the purchase of any product or service from a participating Stickley Audi store location exceeds the maximum retail value of the available credit or prize award, then winner shall be responsible for the difference in the cost at time of prize delivery or acceptance.

8. ODDS OF WINNING: The odds of winning a prize will depend upon the number of eligible entries received and are subject to the selection of the winning entry as described in Paragraph III.
9. PROMOTION DETAILS: THIS PROMOTION IS VOID WHERE PROHIBITED BY LAW.
10. WINNERS: The name of any prize winner may be obtained at the conclusion of the Sweepstakes, and for a period thereafter of up to 60 days by sending a first class stamped, self-addressed envelope to Stickley Audi & Co, 1 Stickley Drive, Manilus, NY 13104.
11. DURATION OF PROMOTION: This Sweepstakes will end on the scheduled termination date of May 31, 2019. If a prize is unclaimed, it will not be awarded to another participant. The Sponsor may, at any time and at their sole discretion, delay the Sweepstakes commencement date, extend the Sweepstakes termination date, or terminate the Sweepstakes in its entirety without notice or obligation of any kind.
12. ADDITIONAL RULES AND RESTRICTIONS:  By participating in this Sweepstakes, entrants agree to abide by and be bound by the Official Rules and the decisions of the Sponsor, which shall be final in all matters relating to this Sweepstakes.  The decisions of Sponsor and any judges selected by Sponsor are final and binding in all respects.  Sponsor reserves the right to disqualify persons found tampering with or otherwise abusing any aspect of this Sweepstakes as solely determined by Sponsor.  In the event an entrant wins a prize, and is later found to be in violation of these rules he/she will be required to forfeit the prize or to reimburse Sponsor for the stated value of the prize if such violation is discovered after winner has used the prize. Participation in Sweepstakes constitutes permission for the Sponsor and its agencies to use winners’ names and/or likenesses for purposes of advertising and trade in any media worldwide without limitation or further compensation unless prohibited by law.  False, fraudulent or deceptive entries or acts shall render entrants ineligible for any prize.   Sponsor is not responsible for any typographical or other error in the printing or advertising of the offer, administration or execution of the Sweepstakes or in the announcement of the prizes/prize winners.
13. IN CASE OF DISPUTES:  By participating, each participant agrees that (1) any and all disputes, claims, and causes of action arising out of or in connection with this Sweepstakes, or any rebates awarded, shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a federal or state court within the State of New York; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with this Sweepstakes, shall be governed by, and construed in accordance with the laws of the State of New York, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of New York or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than the State of New York.
